TERMS & CONDITION
1. BOOKING POLICIES
To secure a booking aboard Dunia Baru, trading as PT. Dunia Baru Adventures (“Dunia Baru”)a deposit is required. The deposit is transferable at the time of booking. Only bookings secured by deposit will be honored. By paying the deposit, the undersigned, on its behalf and on behalf of each passenger of Dunia Baru under this booking (collectively the “Guests”) transferring funds to Dunia Baru, Guests guarantee their full knowledge, understanding and acceptance of all the terms and conditions below
2. NUMBER OF PASSENGERS
The maximum number of passengers for overnight voyages is 14; each within 7 double-bed cabins.
3. INCLUSIVE & EXCLUSIVE, EXCEPTIONS AND SURCHARGES
Trip cost includes: All on board meals, snacks, bottled water & refreshments excluding alcohol; shore excursions as outlined on the itinerary; entrance fees and permits at our seasonal home ports; transfers to/from shore to the ship; services of English-speaking cruise director; service of the crew; use of all water sports equipment including sea kayaks, stand-up paddle boards, Sunfish sailing dinghy, dive equipment including wetsuits for certified divers, snorkel equipment, water skis, jet skis and fishing gear (where permissible by local regulation).
A total of 50 nautical miles per charter day (50 NM) is included in the price of the cruise itinerary. Without additional cost, nautical miles can be accumulated as long as they don’t exceed the total of 50 NM multiplied by the number of charter days. A surcharge may be applied for extra nautical miles.
Trip cost does not include: En-route accommodations at stopover cities at the beginning and end of your trip; aircraft charter fees; international airfare; domestic airfare; excess baggage fees; passport, visas or airport departure fees; entry permits, ports and handling fees outside our seasonal bases, alcoholic beverages; land expedition and cultural program costs; PADI dive certification courses; medical care; any special requests, and resulting transportation costs incurred in acquiring requested items; telecommunication costs for satellite phone & email charges; repositioning fees; all government taxes , cancellation & medical insurance. In rare circumstances, it is possible that prices may be increased. While all efforts will be made to minimize the implementation of surcharges, circumstances under which this may occur include:
- Increase in transportation cost (including fuel cost).
- Increase in local taxes and duties (e.g. freight taxes, landing fees, embarkation/disembarkation fees, sales taxes, etc.).
- Currency fluctuations.
- Significant government or park permit price changes
4. BOOKING AND PAYMENT
4.1 Booking and Deposit
All bookings must be made by electronic mail and state the final cruise dates for the booking, a passenger count, and any special requirements. A deposit of 50% of the charter fee is to be sent to Dunia Baru Adventures, the bank account details of which will appear on the invoice upon signing a binding agreement. Please note that services and booking will not be secured until a deposit is received by Dunia Baru Adventures or their agents.
4.2 Payment of the Balance
Payment of the balance, including any surcharges, must be made to the undersigned’s agent, or directly to Dunia Baru Adventures, 60 days prior to departure date. If full payment of the balance is not received by this date, then Dunia Baru reserves the right to cancel the booking per the cancellation policy as set out in Clause 7.
4.3 Short Notice Bookings
Full payment must be made at the time of booking if the booking is made less than 60 days prior to departure.
5. ALTERATION TO BOOKING
If the undersigned, or an agent on the undersigned’s behalf, wishes to cancel or change a booking in any way, it must be done by email to the point of booking contact and is subject to prior arrangement and approval by Dunia Baru and the terms of Clause 7.
6. CHANGES TO ITINERARY OR SERVICE
Dunia Baru reserves the right to alter previously proposed itinerary schedules and details in accordance with relevant logistical contingencies. Dunia Baru will make every effort to offer equivalent alternatives of comparable standards, and will inform the agent of such changes and resultant implications at the earliest possible date.
7. Cancellation
Notice of cancellation must be sent in writing via email
7.1 Fees
Cancellation by the undersigned is subject to payment of the following fees:
25% of the total charter rate if the cancellation is made more than 90 days prior to scheduled departure.
50% of the total charter rate if the cancellation is made between 89 and 60 days prior to scheduled departure.
100% of the total charter rate if the cancellation is made less than 60 days prior to scheduled departure.
Cancellation fees will be deducted from payment previously made to Dunia Baru and the balance, if any, shall be immediately due and payable to Dunia Baru.
7.2 Insurance
Dunia Baru strongly recommends its Guests to purchase a trip cancellation/interruption insurance to protect the travel investment at the time of contract signature. This coverage will offset cancellation charges in the event of illness before or during the trip. Such trip cancellation / interruption as well as baggage insurances are available at travel agencies.
The purchase of medical insurance with coverage to include international medical expenses, evacuation and 24 hour consultation assistance coverage is also strongly recommended; as is individual diving insurance, such as from DAN (Diver’s Assistance Network), if applicable.
8. Changes to This Privacy Policy
This policy may be updated from time to time. All changes will be posted on this page with a revised “last updated” date. We encourage you to review this policy periodically.
9. Limitation of Liability
Dunia Baru, its owners, agents, employees, and affiliates assume no responsibility or liability whatsoever in connection with the operation or service of any aircraft, motor vehicle or boat, other conveyance, inn, lodge, or hotel which may be used wholly or in part, for services to Dunia Baru Guests.
Dunia Baru, its owners, employees, agents, and affiliates will not be responsible for any act, error, or omission, nor for any injury, loss, accident, delay, inconvenience, irregularity, or damage which may be occasioned by any cause outside its control whatsoever, including acts of nature, civil disturbance, government restrictions, or failure of any means of conveyance to adhere to published schedules.
Dunia Baru reserves the right prior to departure, and after departure, to re-price, cancel or withdraw any tour, trip, or expedition for any reason whatsoever, and to alter or omit any part of the itinerary, to substitute crew members or leaders, or to change any means of conveyance without notice and without allowance of refund with the liability for increased costs, in any, borne by the Guests.
If a booking must be cancelled or interrupted by Dunia Baru due to unforeseen or unavoidable circumstances, such as: acts of insurrection, strikes, acts of God, or any cause beyond the control of Dunia Baru; refunds will be based on the difference between the original trip price and the cost of services already provided.
Dunia Baru is not responsible for: weather, sea or road conditions affecting the cruise and causing delays or re routing, sickness, government action, flight delays and changes due to force majeure.
10. Risk and Release of Liability
Dunia Baru contracts with a network of businesses, firms, governmental agencies, and individuals for field services.
These businesses, firms, governmental agencies, and persons include, but are not limited to, Indonesian or foreign-based companies, subcontractors, business concerns, agents, employees, and associates (all of whom shall be referred to as “third parties”). In many instances, Dunia Baru is required to contract with particular third parties solely at the insistence of a local government or its agencies. Dunia Baru does not supervise and cannot guarantee the performance of such third parties because of, among other things, remote geographic locations, lack of tele-communication facilities, time constraints, and governmental restriction
Therefore, the undersigned, on its behalf and on behalf of each other Guest, knowingly assumes this risk and fully releases and holds harmless Dunia Baru from any and all liabilities for all of the acts and omissions of all such third parties unless Dunia Baru has been shown to be reckless in its dealings with or reliance upon such third parties.
These Booking Terms and Conditions, including the complete assumption of risk of ravel and release of Dunia Baru’s liability hereunder shall be legally binding upon each Guest, all minors under the age of 21 traveling, and each of their heirs, successors, assigns, and legal representatives; it being by intention to fully assume all the risk of travel and to release Dunia Baru from any and all liabilities to the maximum extent permitted by law. It is further agreed that each Guest shall l fully indemnify, defend and hold harmless, Dunia Baru for all its loss, costs, expenses, damages, etc. (including attorneys’ fees), arising from or attributable to any claims or actions arising from Guest’s travel with Dunia Baru and which claims or actions are specifically released by the undersigned, on its behalf and on the behalf of each other Guest, under these Booking Terms and Conditions.
The cost of all Dunia Baru trips has been based upon the undersigned, on its behalf and on behalf of each other Guest, executing these Booking Terms and Conditions. It is understood that its contents and legal ramifications, especially those pertaining to the undersigned, on its behalf and on behalf of each other Guest, full assumption of the risk of travel and the agreement to these Booking Terms and Conditions releases Dunia Baru from any and all liability to the maximum extent permitted by law.
It is agreed that in the unlikely event that a dispute of any kind arises between any Guest and Dunia Baru, the following will apply. The maximum amount of recovery to which all Guests collectively will be entitled under any and all circumstances will be the sum of the booking fee hereunder plus the cost of air travel booked through Dunia Baru.
These Booking Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of Indonesia without reference to its conflicts of law provisions.
It is agreed that in the event any clause or provision hereof shall be held unenforceable by a court of competent jurisdiction, the remaining provisions and clauses of these Booking Terms and Conditions shall remain in full force and effect.
